VIAWEST ANNOUNCES DATA CENTER EXPANSION IN UTAH

ViaWest increases white floor capacity in Utah, to accommodate a growing customer demand

The expansion will encompass an additional 14,000+ square feet in the western-most of the company’s three Salt Lake City area data centers. The construction is already underway, and is slated for completion in the 4th quarter of 2010.

FLSA: CHILD LABOR RULES UPDATED

The DOL has published extensive final child labor rules, containing updates and clarifications, effective 7/19/10. For a DOL fact sheet, click here; the DOL also has side by side comparisons of the major changes to current rules that affect the employment of 14- and 15-year-olds and
hazardous occupations. The updated rules include:

For 14- and 15-year-olds:
"Employment that is not specifically permitted is prohibited." Permitted tasks are no longer just in retail, food service, and gasoline service establishments.
• Specifically permitted tasks (with sufficient safeguards) include intellectual or artistically creative work, e.g., programming, tutoring, singing, etc.
• Also specifically permitted is loading and unloading of certain personal hand tools and items, onto and from motor vehicles. The limits on riding inside or outside the passenger compartments of motor vehicles are clarified.
• Freezers (but not meat coolers) may occasionally and momentarily be entered to retrieve items.
• Work during school hours is allowed for work-study programs (with sufficient safeguards).
• The 3-hour limit on employment on a school day does include Fridays.
• Youths under 16 are prohibited from peddling, non-charitable door-to-door selling, sign-waving (unless directly in front of the establishment), etc.
• Trained, certified youths 15 and older may work as lifeguards and swimming instructors at traditional swimming pools and water amusement parks.
• Under specified conditions, youths 16 and over may operate pizza-dough rollers and portable, countertop food mixers.
Added to prohibited occupations ("Hazardous Occupations") if under 18: work at poultry slaughtering and packaging plants, forest firefighting, forestry services, timber tract management, riding on a forklift as a passenger, operating certain power-driven hoists and work assist vehicles, operating balers and compacters designed or used for non-paper goods, and operating power-driven chain saws, wood chippers, reciprocating saws and abrasive cutting discs.

GOVERNORS TACKLE COMPLEX ENERGY ISSUES AT THEIR ANNUAL MEETING

Whitefish, Mont. -- Western governors continued to deal with critical energy issues at their annual meeting held here. The focus during a Monday plenary session was how best to work within a changing energy landscape after the BP tragedy and how the West can meet its growing energy demands.

Experts who spoke to the governors were Dr. Arun Majumdar, Director of Advanced Research Projects Agency-Energy; Vinod Khosla, founder of Khosla Ventures; David Leuschen, Co-Founder and Senior Managing Director of Riverstone; Rob Bernard, Chief Environmental Strategist for Microsoft, and Ronald T. Evans, President and Chief Operating Officer of Denbury Resources.

The experts agreed that the one thing that is certain is that things will change dramatically and rapidly. They supported continuously working on creating increased demand for clean energy.

Gov. Schweitzer (Mont.) also unveiled WGA's "Transmission Roadmap," a report that can be used by anyone who wants to build a renewable energy facility with transmission. It will be especially helpful for anyone who has not previously done a project. The report will be available soon on the WGA Web site and will be continually updated.

The Governors also passed a major energy resolution that will have the WGA reporting on industrial and commercial energy efficiency programs, the impacts of plug-in vehicles on the electrical transmission system, and issues associated with the expansion of nuclear energy in the West. Of great importance will be using grant funds from the U.S. Department of Energy to develop transmission expansion plans for the West that will not only consider the development of renewable energy, but also wildlife and water concerns.

Incoming Chair, Gov. C.L. "Butch" Otter (Idaho), said he would continue to make energy policy a key concern over the next year.

UTAH DOCUMENTED EMPLOYER REGISTRY NOW AVAILABLE ONLINE FOR CONFIRMATION OF EMPLOYEE IMMIGRATION STATUS

The Utah Department of Commerce announced yesterday that as of June 28, 2010 “Verify Utah,” the Utah Documented Employer Registry, is up and running online for Utah businesses to voluntarily register that they have confirmed new employee immigration status through the federal E-Verify program. Per Senate Bill 251 sponsored by Senator D. Chris Buttars (R) District 10, beginning July 1, 2010 Utah law provides that a private employer who employs 15 or more people may not hire a new employee unless the employer is registered with and uses a status verification system to verify the federal legal working status of any new employee.

WESTERN GOVERNORS ADOPT REPORT ON CLIMATE ADAPTATION PRIORITIES

The Western Governors' Association has published a climate adaptation scoping report that emphasizes the need for coordination between state and federal efforts to identify key science that is Western specific and begins to share and implement smart practices.

The governors adopted the report during their Annual Meeting here this week. Govs. Bill Richardson (N.M.) and Arnold Schwarzenegger (Calif.) are WGA's lead governors for Climate Adaptation. Following is their letter that accompanied the report:

"Across the western United States, we are already experiencing the adverse impacts of climate change on our environment, infrastructure, economies and communities. Clearly, we must implement new management strategies to build a resilient West.

"Western governors recognize the need to work together to respond to these changes, which stand to greatly affect our quality of life. In 2009, the Western Governors' Association (WGA) adopted a policy resolution titled Supporting the Integration of Climate Change Adaptation Science in the West. This resolution represented the governors' interest in a coordinated response to climate change impacts and in including climate science in our policy and management activities.

"The WGA created a Climate Adaptation Work Group, composed of western state experts in air, forests, water and wildlife to recommend next steps. The enclosed Scoping Report is the result of its work. The report contains important recommendations for building a West that is resilient in the face of challenges posed by a changing climate. We are grateful to the work group and all of the partners who contributed their time and expertise to this effort.

"Western states will be on the front lines of climate response, and we are uniquely positioned to lead on this issue. We are pleased to share this report with you, and we urge continued and determined steps toward building state capacity to respond to climate change in the West."
The WGA Climate Adaptation Work Group will work with stakeholders to implement the recommendations in the report, which is available on the WGA Web site at www.westgov.org.
