The EEOC has published new regulations and guidance explaining how it intends to interpret and enforce the major ADA changes passed by Congress.
The EEOC has:
- declared some conditions will virtually always be a disability under the new ADA
- written new rules for what is a disability based on impaired ability to work
- changed the rules for comparing impaired individuals with the hypothetical average person in evaluating disability claims
- written new rules defining what constitutes a "regarded as" disability
