On November 21, 2009, Title II of the Genetic Information Nondiscrimination Act of 2008 (GINA) will go into effect. It protects applicants and employees from discrimination based on genetic information and limits employers' acquisition and disclosure of genetic information.
The proposed EEOC regulations interpreting GINA state that covered entities (including private employers with 15 or more employees) must post notices in conspicuous places describing GINA's applicable provisions. Late last week, EEOC released a revised EEO poster incorporating new required GINA information (www.eeoc.gov/self_print_poster.pdf). As an alternative, the EEOC also released late last week a supplement (www.eeoc.gov/gina_supplement.pdf) which can be posted alongside any earlier versions of the EEO poster to comply with GINA posting requirements. The supplement is attached to this week’s newsletter for your convenience.
