PROPOSED NEW NLRA POSTER

The National Labor Relations Board (NLRB) has proposed a regulation requiring most employers engaged in interstate commerce to post a new notice informing employees of their rights under the National Labor Relations Act. The proposed notice is almost identical to the "Employee Rights Under the National Labor Relations Act" poster required of certain federal
contractors and subcontractors (as of June 21, 2010).

In addition to physical posting, electronic posting would be required if the employer communicates with employees primarily by email or other electronic means. If a significant portion of employees are not proficient in English, the employer would also be required to post the notice in the language the employees speak. In any (unrelated) unfair labor practice charges against an employer, failure to post the notice could result in the NLRB extending the filing deadline and/or considering the failure as evidence of unlawful motive.
