On November 5, the House Transportation and Infrastructure Committee postponed its markup of H.R. 4016, the Hazardous Materials Transportation Safety Act of 2009. The legislation, released late on November 4, met a fury of objections from various transportation-related industries and manufacturers who have three main areas of concern: 1) proposed changes to hazardous materials special permitting, approvals and exemptions managed by the Department of Transportation's Pipeline and Hazardous Materials Administration (PHMSA); 2) new regulations to be issued jointly by the Federal Aviation Administration (FAA) and PHMSA for the safe transportation of lithium cells and batteries onboard aircraft; and 3) an outright prohibition of wetlines, the tubing attached to a petroleum or refined product tank truck that contains remaining product in the lines.
